RESPONSIBILITIES:
- Ensure the Company and its client Companies always comply with local rules and regulations.
- Identify potential risks and exposure to client Companies and the Company and suggest ways to manage and mitigate.
- Ensure that all staff follow Company Procedures.
- Review and develop Company’s Internal Office, Compliance, Client and Statutory procedures and controls.
- Formulate and update the Business Continuity Plan.
- Ensure any matters of concern are formally reported into the board as soon as possible.
- Handle the preparation work and management of all communication with any Regulator.
- Research and understand changes in regulations.
- Ensure adherence to take on procedures for prospective clients.
- Work to develop Anti Money Laundering guidance materials, training resources, and controls.
-Advise senior management of any likely implications of changes to internal policies.
- Prepare reports to the Board of Directors.
- Conduct reviews of files.
- Identify, investigate, and resolve all activities that are deemed noncompliant.
- Provide advice on the implication of future business strategies.
- Inform the relevant authorities of any breaches.
- Completion of all compliance returns as required by the MFSA.
- Address issues relating to transaction monitoring, filtering and sanctions.
- Ensure that the company are compliant with all Laws and regulations not least H&S, Labour Laws, Confidentiality and Data Protection Laws
- Act as the Compliance Officer in terms of the Rules for Company Service Providers and the Code of Conduct for Trustees issued by the - MFSA. You will be expected to demonstrate independence of judgement and to exercise proper day-to-day control over the activity of the - company in terms of the relevant laws, rules and regulations.
- Provide the services of liaison with MFSA where and if needed.
- Mentor and oversee development of any person who may be designated to work in the compliance team.
- Ensure that procedures are in line with existing rules and regulations.
- Provide information and possibly training regarding any new guidelines or rules issued by regulators.
- Provide pre-on boarding risk reports to the Board of Directors. You shall not be involved in the performance of services or activities you - monitor and shall be sufficiently independent from the final client on boarding process.
- Investigate any complaint.
- Monitor incoming and outgoing client funds.
- Responsibility for all matters relating to FATCA, CRS, DAC6 and other reporting to the Inland Revenue Department, and ensuring the - company is compliant at all times.
- Provide opinion or advice from a compliance perspective to be considered in risk and risk strategies.
- Ensure that the filing system is in order.
- Update the Errors and Breaches Register, informing the MFSA where and if required.
- Sign off adverts.
Requirements
- At least four years’ experience within a compliance department of a CSP or Trustee services company in Malta.
- Based in Malta
- Compatible with the requirements that are envisaged in the new Rules for CSPs especially if the person has not yet been authorised by the mfsa to act as Compliance officer for a CSP/Fiduciary Service company.
- Must have a good track record in Compliance positions.
